When I entered the game through the church stage a cleric player invited me to his party, then he got me killed and stole all my gems. I had over 20 gems.
First off, how did he got you killed?
Second, when you enter certain maps, there is a message in the chat saying that you will lose your gems if you die there, and by Church you mean Tenet Church maps, B1 and 1F both have statues, you could pretty much go back to city, store your gems on the Storage NPC and go back to your leveling.
Third, anyone would go get the gems on the ground if they became available to be picked.
I only see yourself to be blamed here imo.

it never worked for me, saw so many monster gems disappear 
I think when you are in party it is possible, not for outsiders tho.
The player that stole the gems invited me to a party as soon as I entered the game. The player lead me to a higher level area and used the npcs by agroing them on himself, then lead the npc to me to kill me twice. An admin should get my gems back or create duplicates to replace mine. and ban the player that did this it was in channel 12 SA server at about 5:00 a.m. est
Its not my fault. I didn’t make the system that the thief exploited. It shouldn’t have been possible for the thief to do any of that. The theif shouldn’t be allowed to get away with this. I should get a reimbursement for what he stole. it’s has pretty much broke my character. I don’t have any of the gems I collected the entire game that I need. And the game should be fixed, so that what the theif did can’t be done anymore.
You cant pick up other peoples gems when they die.
Store gems in storage so you dont lose them. Gems are easy to get anyway. You are overreacting.

Without any names or screenshots it will be hard to determine who it was.
Are you sure he stole the gems and they didn’t just disappear after a while?
Last time a party member in one of my instance runs died nobody was able to pick up his gems and after ~1 minute the just disappeared.
Did the gems just disappear after a short while or did they gravitate towards his character, which means you saw him pick them up?
That being said : my advice would be leaving gems at the storage when going on dangerous maps.
When he has aggro you shouldnt die at all. you can manually evade almost every attack.
Also you might consider
a) warnings are there for a reason
b) keep them in mind with every action you take
c) gems cannot picked up by others
d) use your storage
e) he didnt do anything against the games user agreement, although its kindof mean
f) understand this as a lesson to be learned
If you don’t have the space to put away your gems, just upgrade them. Sit down and open up the gem enhancement window. Use gems to upgrade other gems.

Better than get yourself killed and lose about 50 gems. Yeah that idiot is me and i don’t even bother about it XD

You’ll be able to get more gems later on, and they’re pretty easy to farm when you’re at a higher level (farming lowbie areas).
