I always thought VAC gives an immediate ban when a bot/script is detected. Could anyone explain it to me?

I guess this is exactly the case here, the servers aren’t VAC protected:
Insecure servers
Some VAC protected games allow servers that are not protected by VAC, known as insecure servers. Users that are VAC banned are still able to play on insecure servers for the game they are banned from. Please note that not all games have insecure servers.
I read this guide already, didn’t learn anything besides “YOU CANNOT CHEAT OR IT WILL RESULT IN A BAN”, which is a pretty common knowledge lol. Yet no bans have been imposed, only by ToS staff due to the reports themselves.
VAC is turned on for ToS.
Vac only detects changes to the actual in-game client or server code.
3rd party programs… that utilize functions of the game, but don’t actually change anything, can get around it quite easily.
Counter-Strike has had the same issue with aim-scripts for years.
Uh, isn’t it a bit contradictory? What would IMC turn on VAC for then?

I remember one guy asking in these forums if it’s allowed to use a zoomhack. Not sure what it is but I suppose zooming out camera so you can easily cover bigger part of the map… Since it’s utilizing functions as well, I guess it shouldn’t be bannable by VAC?
What are the examples of hacks that change something? Would you be able to refer somehow to ToS. Maybe duping the items…?
EDIT: One last question, isn’t VAC supposed to detect a program running in the background that somehow influences on the usual gameplay?

exactly. the zoomhack just makes a bigger part of the map visible by bypassing the zoom restriction. Its just utilizing ingame functions of ToS thats right, but its violating against the rules cause it gives you a certain advantage so it should be bannable…

- thats the problem, you can just rename the process of the programm and VAC cant find it anymore (for example, name your hack explorer.exe), so they would need file check routines etc. to detect them any further… and those routines are a big problem legally cause they violate your own “file” privacy

VAC is owned by valve, which is owned by Steam.
As an American based company… it is illegal for steam to actually scan your hard-drive in such a way. (Some other instances… like… scanning in the installed steam folder itself to detect games that need updating or otherwise are allowed, because you agreed to it in the user agreement when you installed steam… if you bothered to read it.)
In TOS… I wouldn’t know FOR SURE, because I haven’t run across anything like it yet… but I assume… a natural change to the code would be:
-To give their I.P. admin mode (that would involve adding another ip number, and hence another line of code to the actual program)
-Develop some way to give themselves free items (would require adding code to let them spawn what they want)
-General changes to the physics, worldmaps, background music… Anything that was set in stone during the developers upload. (That isn’t covered in an open-source type agreement through steam)
Basically, If someone were able to open the games code on the server… and change the green grass texture in orsha feilds… to a plate metal tile from one of the dungeons… ect… VAC would detect it.
