Law class action against IMC regarding Silute (SA) server

Not only some SA players asked for it, but non SA players also wanted to get rid of us. Did you forget?

Did IMC put a gun to those players head and force them to change server?Or did non SA players forced them?

It really doesnt matter what your law statement is on internet services, as e.g a DDoS is 3rd party action and can not cover up for a warrant action against the service provider. On the other side if servers were downright not powerful enough this would be at companies own fault.

I do not think you have any basis for your case. Reason:
You did not pay for access to the game, you only paid for the DLCs, aka the items.
You probably recieved the items, which means they fulfilled their part of the deal when you paid them money for the DLC.
When buying the DLC items you are only guaranteed that the items are available on your account, which probably is true.
Buying DLC does not mean you paid for good server services, though.

You did not pay for server access, you paid for virtual items to be delivered to your account.
That has been fulfilled, you did not pay for server availability.

To give you an analogy :
When buying food you pay for the food, aka the items. However you do not pay for a guarantee that you actually like what you’re buying.
You can’t, for example, buy lasagna and then aftewards complain and sue them because you don’t like lasagna.
Just like that you pay for virtual items, however you do not pay for server accessibility.

If there was a subscription option with a direct real money<->game time exchange or a initial game cost with a guarantee that the servers are always accessible then you’d have a right to complain or even sue.
However since all you pay for is virtual currency (TP) or virtual items (DLC items), which are no doubt delivered to your account you don’t really have any case for sueing them, since they delivered everything you paid money for.

If your family truly runs the largest law firm in the country, why are you asking on the forums if you have any chance of success when sueing them?
Why not ask your daddy or mommy or whoever is in charge of said law firm? I’m pretty sure, if you’re telling the truth, they could help you alot better in this case than people on the forums here.

And how is sueing them solving the server problems? It’s so short-sighted.
If you win you cost them alot of money and time. Good job, now they’ll have even less money/time to solve the server problems.

You may try sueing them if you want. However i don’t think IMC likes people sueing them. After trying to sue them, regardless of the outcome, IMC will probably immediately terminate your account, because, as usual with online games, they have the right to terminate your account for any reason and without any explanation. So if you’re successful with sueing them you probably won’t be able to play the game anymore at all.

Also, you can’t sue them just because the servers are slow because they’re getting DDoSed.
That’d be like sueing a bank for getting robbed by gangsters while you were at the bank.
Or sueing a power company for power outages caused by a tornado.
Do you think the bank chose to get robbed? Do you think the power company wanted that tornado there? Do you think IMC wants DDoS attacks to happen? It’s an external force that can not really be prevented and thus it’s not their fault that it’s happening.

I’ve asked refund from 3 DLC’s pack i did not have used ATM… But where is IMC to answer and send my money back?!
I’m in mind that IMC will answer me in a month with an automated message (like always) and won’t give my money…

I’m really tired of this company… Thought I’ve passed all the worst with Level Up! but IMC is showing us another level of failure, incompetence and everything that is bad. :S

If you bought it through Steam then Steam is responsible for refund, mot IMC.

if you agreed to the terms of service, you agreed to their right to deny service at anytime for any reason.

So sorry, you have no case.

Well, not like any other game… We never had to accept an EULA or whatever to play the game…

Steam DLCs in general are usually not eligible for refund, even when unused.
When buying DLC from Steam below the “add to cart” button it says "This product is not eligible for refund."
There are exceptions, though, so if you’re lucky they might refund it. Technically they don’t have to, though.

Steam store page of TOS, right side, above publisher/developer information :
“Requires agreement to a third party EULA : Tree of Savior EULA”.
By starting and playing you automatically accept this agreement.

What i was referring to was player location that doesn’t count people in SA playing on NA it counts ip locations. So what you said is completely irrelevant.

Well not all games on Steam has this EULA agreement on the store page but so far not only ToS, some titles like The Witcher 3 has it as well. U can check on ur own.

Well I’m just adding that DLCs for this case are indeed not eligible for refund so incase u are about to swear to them, u better blame urself for not reading it properly before purchased them.

A SCAM where they don’t tell you the product is not complete. It’s SCAM, False advertasing. Everyone with a beginner’s pack have the RIGHT to a refund or fix of this token.

You can’t sell a product like that. In game it is said you get trades from the token, and we didn’t get it. I got my pack BECAUSE of the trade.

I don’t think they will refund, and the most possible way is changing the token. It’s not eligible for refund in the first place so u have NO rights to ask for refund but u have rights to ask about the token.

It’s like u are buying a thing but u got different stuff so u can ask for the correct one. Eventho actually they already posted them as different stuffs but ya, lack of explanations.

As for the outcome, it depends on them but seeing the agreement before u buy, most likely the second since it will be connected to Steam as well.

Notice the diff here, if u are asking for refunds it will be wrong but if are asking about the token, the outcome might be varies, change the token or give u back ur money or anything.
